The Patient and The Weather (TPATW) PROVIDES NO MEDICAL ADVICE. The complete contents of the TPATW website, either created by ERREx, Inc. or obtained from third parties, are for informational, situational awareness, or risk assessment purposes only. No content, either regarded individually or collectively, should be a substitute for professional medical consideration.

TPATW TERMS OF USE. By accessing and/or using TPATW website or mobile app information or services, you affirm that you have read and agree to the TPATW TERMS OF USE currently in effect. If you do not agree to the terms and conditions, do not use TPATW! TPATW TERMS OF USE may change from time to time. Your continued use of the TPATW website or mobile app information or services after changes to TPATW TERMS OF USE means that you accept those changes.

CONTENT COPYRIGHT. The information, graphics, concepts and methods posted as CONTENT on TPATW is covered by the copyright laws in the United States and other countries. TPATW allows the use of TPATW CONTENT solely for personal, noncommercial use. You have no other use rights. You have no ownership or rights of ownership. Ownership of the TPATW CONTENT (except for Vitality Diary User Data as defined below) remains with TPATW. TPATW CONTENT is subject to change or removal without notice.

NOT APPROPRIATE FOR MINORS. TPATW is not designed for anyone under 18 years of age. TPATW does not and will not knowingly support the registration or use of the TPATW website or mobile app information or services by anyone under 18 years of age.

LIABILITY. Your use of the TPATW website or mobile app information or services is at your own risk. ERREx, Inc. and any TPATW third parties assume no liability for the TPATW CONTENT, its accuracy, timeliness, or presentation of any data or other information transmitted in connection with use of TPATW website or mobile app information or services. All TPATW CONTENT is provided “as is”. TPATW is not liable for any personal injury, including death, caused by use or misuse of TPATW website or mobile app information or services. THIS IS NOT A MEDICAL SITE.

GUARANTEES OR WARRANTIES. THERE ARE ABSOLUTELY NO GUARANTEES OR WARRANTIES, EXPRESSED OR IMPLIED.

JURISDICTION. TPATW is based in Harrisburg, PA in the United States of America. If you access TPATW, the exclusive jurisdiction for any dispute with TPATW, or in any way relating to your use of the TPATW, resides in the courts of the Commonwealth of Pennsylvania. If you access the TPATW information or services from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

Compliance with Law, Regulation, and Law Enforcement Requests. TPATW cooperates with government and law enforcement officials to enforce and comply with the law.

ADVERTISING. TPATW may allow advertising on The Patient and The Weather website or mobile app information or services from third parties. The advertiser(s) is/are solely responsible for the content and accuracy of their advertising. TPATW maintains sole discretion with this advertising policy and may change this policy at any time by publishing a revised policy to its website or mobile app information or services. TPATW acceptance of an advertisement is not an endorsement of that company, their product(s) and/or the service(s) advertised.

USER INFORMATION. Any personal information submitted to TPATW is governed by the TPATW PRIVACY POLICY. The TPATW website or mobile app information or services offer TPATW CONTENT as updated from time to time, and user interactive areas including a USER VITALITY DIARY and a USER BLOG. Users are encouraged to post or upload content and other information. By submitting information and data to TPATW, the user agrees to comply with the TPATW TERMS OF USE. TPATW reserves the right to remove user content which we believe violates the TPATW TERMS OF USE or for any reason.

By submitting any communication or information to TPATW you agree that each submission, in whole or in part, is non-confidential for all purposes and does not infringe or violate the rights of anyone else, including trademark, copyright, or privacy. You also agree that you will upload no material that contains software viruses or other coding with intent to interrupt, destroy or harm the functionality of the TPATW website or mobile app information or services.

TPATW PRIVACY POLICY. TPATW understands how important the privacy of personal information is to our users. This TPATW PRIVACY POLICY identifies the information we collect. It explains the choices you have about how your personal information (if any) is used and how we protect that information. We urge you to read this Privacy Policy carefully. This TPATW PRIVACY POLICY applies to the TPATW website or mobile app information or services owned and operated by ERREx, Inc. for the intended use by consumers (non-professionals) for non-commercial use. Should you provide certain information by which you can be identified when accessing your account information, such information will only be used in accordance with this privacy statement. We DO NOT share your non‐public personal information with unaffiliated third parties.

INFORMATION WE COLLECT ABOUT YOU

REGISTRATION. Limited TPATW data are provided to the general public and may be accessed without registration. Most TPATW information and services are made available only to registered (trusted) users. TPATW registration requires each user to create a unique username and confidential password, and to associate their TPATW account with a valid email address. Additional account personal information may be entered but is optional. Each user can view, edit, or delete their personal information at any time. TPATW Administrators can also TPATW and edit that information.

USER VITALITY DIARY. TPATW algorithms link your personal vitality index with weather and environmental factors. To achieve this, TPATW must acquire and log your geographic locations and your reported vitality level at reported times and associate these data with your account. These data collectively comprise your USER VITALITY DIARY. TPATW does not allow any third parties (e.g. advertisers) to gather any data about you in connection with your use of the USER VITALITY DIARY.You have the right to edit or delete data in your USER VITALITY DIARY at any time, although we maintain the right to make use of that information internally on an anonymous basis.

While there is currently no plan to do so, should there be an opportunity to commercialize the vitality data volume in the future, it will not be provided to a third party unless it is deidentified or your permission is obtained (2 consecutive emails to the contact address provided by you). If permission is needed, there will a methodology developed by TPATW to share a portion of any compensation acquired with the data providers (TPATW USERS). There are no audit rights provided or implied by this policy.

DEVICE INFORMATION. When you access TPATW information and services, the TPATW server automatically collects and logs information provided by your browser or mobile device including IP address or unique device identifier, browser information including URL, preferences and settings, cookies and information about the content you have viewed and actions taken. When enabled by you, TPATW also collects geographic location information provided by your mobile device.

USER TRACKING and COOKIES. TPATW and other potential third parties use cookies and/or tracking technology to collect information about your use of TPATW services. The information collected may be combined with your account information including your name, email address and physical address, so that we can send you materials that may be of interest to you. Two of the most common third parties TPATW might cooperate with are Google and Facebook. You should review the privacy policies of GOOGLE and Facebook on their web sites.

BLOG. Registered TPATW Users will be able to submit feedback or comments to the TPATW BLOG. Any information (including personal information) you may share in any comment to the TPATW BLOG is open to the public and should not be considered private. If you leave a comment, the comment and its metadata are retained indefinitely. If you post personal information in our blog areas, we may not be able to remove your personal information.

EMAIL. This Privacy Policy does not apply to information of any type sent to TPATW by email.

HOW WE USE YOUR PERSONAL INFORMATION. Information about your use of the services may be used to provide, improve and create new Services, or to provide you and people with similar demographics and interests with more useful content. Your correct contact information is used when we respond to inquiries and to send you administrative communications about the TPATW website or mobile app information and services, or to obtain feedback. Most importantly, the information is used when we send you secure electronic messages and personalized emails pertaining to your health weather risk assessments as requested through your registration and service needs. Internally, we use depersonalized information to analyze statistics and trends about user behavior and activity including how frequently areas of the TPATW sites and app are visited.

TPATW THIRD PARTIES. TPATW may work with third parties to provide services and to assist in the operation of the TPATW website or mobile app information or services. We may share information, such as a cookie ID or IP address, with third party providers who may use this information, on our behalf, to help TPATW deliver advertising on the TPATW website or mobile app information or services. While TPATW contractors may have limited access to your information in the course of providing products or services, ERREx, Inc. contractually mandates subcontractors not to use or disclose user information for any purpose other than providing the limited service or activity for TPATW.

HOW YOUR INFORMATION IS SECURED AND RETAINED. TPATW takes reasonable security measures to protect the security of your personal information. There is always some risk that an unauthorized third party may breech our security systems or that transmissions of your information over the Internet may be intercepted. TPATW retains your personal information as long as your account is active or as needed to provide you a service. The USER VITALITY DIARY information is owned by you. It can be deleted by you at any time. We will also retain your personal information as necessary to comply with legal obligations, resolve disputes and enforce our agreements.If you do not want your personal information used by TPATW as provided in this Privacy Policy, you should not use the TPATW website or mobile app information or services.
